documentary artefact; property indenture

Indenture manuscript, handwritten. The document is mounted onto a piece of cardboard. There is a wax seal on the bottom right corner of the document. The inscription reads:' This indenture made the nine and twentieth day of September in the third year of ye reign of our Soveraigne Lord George by ye Grace of God of Great Britain France and Ireland King Defender of ye faith between Martin Killigrew of Arwenack in ye County of Cornwall Esq on the one part and Thomas Deeble of ye towne of Falmouth in the County of Cornwall Ropemaker of ye other part. Witnesseth that the said Martin Killigrew as well for and in consideration of ye yearly rent convenants conditions reservations and agreements herein affor mentioned oppressed and reserved on ye part and behalf of ye said Thomas Deeble his [?sper adms] and assignes to be yielded paid done and performed as also…for…other good…and considerations him ye said Martin Killigrew thereunto especially moveing hath granted devised leased so…[…?] gotton and confirmed and by these present doth grante demise lease sell to farme lott and confirm unto the said Thomas Deeble his [?spo…adm]…and assignes All these four rooms that is to say two ground rooms and two chambers part and prell of a tenement or dwelling house late in ye tenure and possession of one Kimberlyn situate lying and being in said towne of Falmouth and also a shed Lynney or outhouse lately erected and built near ye said dwelling house together with all ways proffitte easement comoditys advantages + appurtures whatsoever to ye said demised promised belonging or in any wise appertaining all which said promises now are in ye tenure possession and occupation of ye said Thomas Deeble his assignee or assignes to have and to hold the said rooms Lynney outhouse and premises with the appurttres unto ye said Thomas Deeble his spor…adm and assignes from ye day of the date hereof for and during the full and whole term and space of seaven years henceforth next and immediately ensuing fully to be complete finished ended toe the said Thomas Deeble his spe…adms and assignes yielding and paying therefore yearly and every yeare during ye said hereby demised terme unto ye said Martin Killigrew his heires and assignes ye full and whole sum of four pounds of lawful money of Great Britain at ye four most usuall foafts on days of payment in ye yeare aforesaid And shall and will also from time to time + at all times hereafter during ye said demised term at his and their own proper cost + charges well + sufficiently repaird + maintained ye glass windows of ye said demised premises when + so often as need shall require p-y same so well and sufficiently repaired + maintained at ye end of ye said terme shall and will lease and yeild up..... [continues...] And if and when and so often as it shall happen ye said yearely rent a sum of four pounds ……to be behind and unpaid in part or in all by ye space of twenty days next after any or either of the feasts or days of payment aforesaid in which ye same ought to be paid being lawfully demanded + then not paid noe sufficient distress in or upon ye said premises at ye time of such demand made can or may be openly found had + peaceably taken whereby ye said rent with ye arrearage thereof (if any shall happen to be) shall and may be levyed paid. That then and from thenceforth it shall and may be lawfull to and for ye said Martin Killigrew his heirs and assigns into and upon all and singular ye said hereby demised promiss with th’appurtures to reenter and ye same to have againe retain repossess and enjoy as in his and their first and former estate these ipsents or any thing herein contained to ye contrary thereof in any wise notwithstanding And the said Martin Killigrew doth for himself his heirs + assignes + for every of them Covenant promise and grante to and with ye said Thomas Deeble his ?....adm + assignes + to and with every of them by those presents in manner + forme following that is to say that he the said Martin Killigrew his heirs + assignes shall + will from time to time +at all times hereafter during ye said hereby demised terme at his + their owne proper cost and charge well and sufficiently repair sustaine maintaine and uphold all and singular ye said demised promises in wall lowering + all other needful+ necessary repairations whatsoever (the glass windows only excepted) when + so often as need shall require. And thathe ye said Martin Killigrew his heirs + assignes shall + will also from time to time and at all times hereafter during ye said hereby demised terme at his +their owne proper costs + charge well+ sufficiently repair sustaine maintain and uphold all and singular ye said demised promises in wall lowering + all other needful + necessary repairations whatsoever (the glass windows only excepted) when + so often as need shall require. And that the ye said Martin Killigrew his heirs + assignes shall + will also from time to time and at all times hereafter during ye sadi hereby devised term free acquit discharge save harmeless + indempnifyed ye said Thomas Deeble his spo…adm + assignes + ye said hereby demised promises with th’appurtures of and from all + all manner of rates taxes charges payments impositions outgoings + demands whatsoever that now or at any time hereafter during ye terme aforesaid shall or may be issueing due and payable out of or for or in respect of ye said hereby demised promises or any part thereof to any person or persons whatsoever or in any wise howsoever (ye yearely rent hereby reserved only excepted) And lastly that the ye said Thomas Deeble his spo…adms and assignes in manner and forme aforesaid + during ye terme aforesaid by and under ye rents +covenants aforesaid shall and may quietly and peaceably have hold occupy possess and injoy all and singular ye said hereby demised premises aith th’appurtnses without ye lawfull both suite….molestation disturbance or denyall whatsoever of or by himye said Master Killigrew his heires + assignes or any or either of them or of or by any other person or persons whatsoever In witnesse whereof ye partyes abovesaid to these present indenture their hands and seales interchangeably have sett yeesen ye day and yeare first above written Annoys Diui 1716
